1. Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the website operated at qwer.poki.love (the “Service”), including all associated pages, subdomains, and the browser-based games and content made available through it. By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree with any part of these Terms, you must discontinue use of the Service immediately. Continued use of the Service after any changes to these Terms constitutes acceptance of the revised Terms.

2. Service Description

poki.love operates a free, browser-based game hub currently offering 50 casual HTML5 games across categories such as action, puzzle, card & board, arcade, and strategy. The Service is designed for instant play on modern desktop and mobile browsers without requiring account registration, installation, or local downloads of game binaries.

The Service is funded in part by third-party advertising delivered through Google AdSense and Google AdX. The presence of advertising is the trade-off that allows the games to remain free of charge. Ads may appear before, between, or alongside game sessions, and may be selected based on contextual and, where permitted, cookie-based signals as described in our Privacy Policy.

Each game available through the Service remains the property of its original developer or rights-holder. poki.love does not claim ownership of any third-party game, sound, artwork, or code embedded in the catalog. Your use of any individual game is additionally subject to the terms, if any, imposed by that game's developer.

We may, at our sole discretion and without prior notice, add, remove, temporarily suspend, or permanently retire titles, categories, features, or the Service as a whole. We do not guarantee the continued availability of any specific game or feature.

3. Eligibility

All content created and published by poki.love on the Service — including but not limited to the poki.love name and logo, page designs, layout, graphics (excluding game assets), text, editorial descriptions, source code, CSS, JavaScript, the mobile app-shell, and the compilation of the catalog — is owned by poki.love or its licensors and is protected by copyright, trademark, and other applicable intellectual-property laws.

5.2 Games

The games available through the Service are the property of their respective developers and rights-holders. poki.love does not claim any ownership, authorship, or moral rights over those games. All game-related trademarks, logos, and character names remain the property of their respective owners, and any references are used solely for identification and editorial purposes.

5.3 User-Submitted Content

If the Service later allows you to submit content (for example, comments, reviews, usernames, or feedback), you retain any intellectual-property rights you have in it, but you also grant poki.love a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content through the Service and related promotional materials, subject to applicable privacy law.

If you believe that content hosted on or accessible through qwer.poki.love infringes your copyright, you may submit a copyright notice to our designated contact. Please send your notice to support@poki.love with the subject line “Copyright Claim” and include the following:

7. Advertisements — Google AdSense and AdX

We display advertisements served by Google AdSense and Google AdX. These advertisements are provided by Google and by third-party advertising partners that participate in Google's advertising networks. The presence of advertising is what allows us to keep the games on qwer.poki.love free of charge.

These advertisements are provided by Google and third-party advertising partners. They may be selected using contextual signals (such as the game you are playing or the page you are viewing) and, where you have consented or applicable law permits, cookie-based or device-based signals. • Encourage, facilitate, or assist any third party in doing any of the above.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. Your use of the Service is at your sole risk. To the fullest extent permitted by applicable law, poki.love, its affiliates, licensors, partners, and suppliers expressly disclaim all warranties of any kind, whether express, implied, statutory, or otherwise.

Without limiting the foregoing, we make no warranty that:

• The Service will be uninterrupted, timely, secure, error-free, or free of viruses, malware, or other harmful components.
• The results that may be obtained from the use of the Service will be accurate or reliable.
• The quality of any game, content, or service obtained through the Service will meet your expectations.
• Any errors or defects in the Service will be corrected.
• Any particular game will remain available, functional, or free of third-party modification.

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of content, and quiet enjoyment. We do not warrant the accuracy, completeness, or usefulness of any advertising or third-party content appearing on the Service, including content delivered through Google AdSense or AdX.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall poki.love, its affiliates, officers, directors, employees, agents, licensors, partners, suppliers, or advertisers (including Google and Google AdX advertising partners) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, revenue, goodwill, use, data, or other intangible losses, arising out of or in connection with your access to, use of, or inability to use the Service.

This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not poki.love has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability will be limited to the maximum extent permitted by law. In all other cases, and notwithstanding anything to the contrary in these Terms, the total aggregate liability of poki.love and its affiliates for any and all claims arising from or related to the Service shall not exceed the greater of:

• The amount you have paid to poki.love, if any, for use of the Service during the twelve (12) months immediately preceding the event giving rise to the claim; and
• One hundred U.S. dollars (US $100).

Because the Service is provided free of charge, in most cases the applicable cap will be US $0 or, at most, US $100. This allocation of risk is reflected in the pricing of the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless poki.love, its affiliates, and their respective officers, directors, employees, agents, licensors, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your access to or use of the Service.
• Your violation of any provision of these Terms.
• Your violation of any third-party right, including any copyright, trademark, privacy, or proprietary right.
• Any claim that your conduct, including any content you submit or any interaction you initiate with advertisers or other users, has caused damage to a third party.

This indemnification obligation will survive the termination of these Terms and your use of the Service.

We reserve the right to modify, update, or replace these Terms at any time, for any reason, including to reflect changes in the Service, applicable law, advertising policies (including Google AdSense and AdX policies), or industry practice. • Any request from a developer, rights-holder, or law-enforcement authority that we remove or restrict specific content.
• Any operational, security, or business reason.

You may stop using the Service at any time. Because no personal account is required, ending your use is as simple as closing the browser tab or clearing local browser storage. The provisions of these Terms that by their nature should survive termination — including those concerning intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive any termination.

14. Governing Law

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws applicable to the operator's place of business, without regard to conflict of law principles. The specific governing law and venue shall be determined by poki.love and communicated in the event of a formal dispute, consistent with applicable law.

Nothing in this section limits the application of any mandatory consumer-protection law in your country of residence that cannot be displaced by agreement.

15. Dispute Resolution

We encourage you to contact us first if you have any concern, complaint, or dispute about the Service. Most disputes can be resolved quickly and informally by emailing support@poki.love with a clear description of the issue and any relevant evidence. We will endeavour to respond within a reasonable timeframe.

If a dispute cannot be resolved informally within a reasonable period, you and poki.love agree to attempt in good faith to resolve it through a non-binding alternative dispute resolution process before initiating any formal legal proceeding, unless either party seeks interim injunctive relief to protect its rights or interests.

Notwithstanding the foregoing, either party may bring an individual action in a court of competent jurisdiction for claims that qualify for small-claims court. Nothing in these Terms waives any mandatory right you may have under applicable law.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent.

These Terms, together with our Privacy Policy and any additional policies referenced herein (including the Google AdSense and AdX advertising policies), constitute the entire agreement between you and poki.love with respect to your use of the Service. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and poki.love regarding the Service.

No waiver by poki.love of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, or of any other term or condition. Any failure of poki.love to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
